Terms and Conditions

These Terms and Conditions ("Agreement") govern your enrollment, participation, and interaction with Draw It With Me, LLC, a Utah-based after-school art academy (the “Company”) that provides drawing, painting, and craft-making lessons for children and adults. By enrolling or participating in the Company's programs, you ("you," "your," or "Participant") agree to be bound by these Terms and Conditions. If you do not agree with these terms, you must not enroll in or participate in any of the Company's programs.
1. Enrollment and Registration
To enroll in the Company's programs, all participants (or their legal guardians, in the case of minors) must complete the registration process by submitting all required forms, including but not limited to health information, emergency contact information, and any additional information requested by the Company. By enrolling, you acknowledge and agree that the information provided is accurate, complete, and up to date. Any changes to the Participant's contact or health information must be promptly communicated to the Company.

2. Participation and Conduct
Participants must adhere to the Company's code of conduct while attending any classes or activities. The Company reserves the right to remove any student from a class or event if the student engages in disruptive, unsafe, or inappropriate behavior. In such cases, no refund or credit will be provided.The Company maintains the right to set standards and expectations for student behavior and will provide guidelines on classroom behavior and conduct. Parents or guardians of minors are responsible for ensuring that their children adhere to these guidelines.
3. Liability and Assumption of Risk
You acknowledge and agree that participation in the Company’s programs or sessions involves certain risks, including but not limited to the risk of injury to yourself or others, the risk of damage to or loss of personal property, and the risk of exposure to potentially harmful materials or substances (e.g., paint, chemicals, tools). By enrolling in the Company's programs and/or sessions, you voluntarily assume these risks and agree to hold the Company, its owners, employees, agents, contractors, or representatives harmless from any claims, damages, or injuries that may arise out of participation in the program or sessions. Parents or guardians of minor children acknowledge and assume full responsibility for the safety and well-being of their children during all Company sessions, classes, summer camps, or programs. This includes, but is not limited to, injuries sustained while in the care of Company instructors or while using materials and equipment provided and/or used during any class or session.
4. Injury and Medical Treatment
The Company does not provide medical insurance for Participants. In the event of an injury or medical emergency, the Company will make reasonable efforts to contact the emergency contacts provided during registration. However, by enrolling in the Company's programs, you consent to the Company seeking emergency medical treatment for a Participant if needed. You are responsible for all medical expenses arising from such treatment.
5. Property Damage
Participants are expected to respect Company property and the property of others. The Company is not responsible for personal items that are lost, stolen, or damaged during class or on Company premises. Parents or guardians will be held responsible for any damage to Company property caused by a minor Participant.
6. Refund and Cancellation Policy
Refunds for program or session fees will only be considered under certain circumstances, as outlined below: A full refund is available for cancellations made at least 7 days prior to the program or session start date. Cancellations made less than 7 days before the program or session start date may be subject to a 50% refund, depending on the circumstances. No refund will be provided for cancellation 24 hours or less prior to start of program or session, except in the case of illness or emergency, or a makeup session may be scheduled as availability permits at the discretion of the Company. No refunds will be provided after the program has commenced, except in the case of illness or emergency at the discretion of the Company. If the Company cancels a program or session, participants will be entitled to a full refund or may choose to transfer to another available program or session.
7. Photography and Media Release
By participating in the Company's programs or sessions, you grant the Company permission to take photographs and videos of Participants during class, sessions, activities, or events. These materials may be used for promotional purposes, including but not limited to social media, the Company website, and marketing materials. If you do not consent to this, you must notify the Company in writing prior to the start of the program.
8. Changes to Programs or Policies
The Company reserves the right to modify, alter, or cancel any program or session, including changes to scheduling, location, instructors, or curriculum, as deemed necessary. In such cases, participants will be notified promptly. If changes significantly impact the Participant’s ability to attend or participate, a full or partial refund may be provided at the discretion of the Company.
9. Modifications to Terms and Conditions
The Company reserves the right to amend or revise these Terms and Conditions at any time, without prior notice. Any such changes will be posted on the Company website and will be effective immediately upon posting. Continued participation in the Company’s programs following the posting of changes constitutes your acceptance of the revised Terms and Conditions.
10. Privacy Policy and Data Protection
The Company values the privacy of its Participants and complies with applicable data protection laws. Personal information provided by Participants during the registration process will be stored securely and used only for purposes related to program enrollment and communication. We will not share your personal information with third parties, except as required by law or in cases of emergency.
11. Force Majeure
The Company shall not be held liable for any failure to perform or delay in the performance of its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to acts of nature, government regulations, strikes, or other unforeseen events.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the State of Utah, United States. Any dispute arising from or related to these Terms and Conditions shall be resolved through binding arbitration, conducted in Salt Lake City, Utah, under the rules of the American Arbitration Association. Both parties agree to waive their right to a trial by jury.
13. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remainder of the provisions will remain in full force and effect.
